General Terms and Conditions of Sale and Use (GTCU)

The use of the services of our site as well as any reservation implies the prior, full and entire acceptance of the present General Conditions of Use and Sale and of our Personal Data Protection Policy, which you acknowledge having read.
Application
The present General Terms and Conditions of Sale and Use ("GTCS") are concluded between OCEAN12 and any individual, non-trading, wishing to make a reservation, whether he/she reserves personally or for a third party.
Each time you visit the Site, you agree to comply with the General Terms and Conditions, which apply to all services available on the Site, whether provided free of charge or sold.
You accept all the General Conditions before any purchase, consultation of information, simple free use of the site or any reservation, whatever the means of reservation.
Ocean12 is free to modify the Terms and Conditions at any time in order to adapt them to the evolutions of the site and/or legislation.
The new Terms and Conditions are applicable as soon as they are posted on the website.
However, the Terms and Conditions applicable are those in force on the day of booking by the Customer.
You are therefore advised to refer regularly to the latest version of the General Terms and Conditions, which are permanently available on the Site, and to cease using the Site in the event of disagreement with the General Terms and Conditions in force.
1 - Opposability
Booking on the Site is exclusively reserved for retail booking.
Under no circumstances may the Site be used by professional sellers, alone or in groups, regardless of how their products are marketed (e.g. Internet marketplaces, shopping malls, intermediaries, physical stores).
You therefore acknowledge and accept that our reservations can only be made in limited quantities.
Ocean12 reserves the right to refuse any booking obviously validated by a professional seller.
Ocean12 reserves the right to refuse a booking or sale for any legitimate reason (e.g. insulting behaviour of the customer, etc.).
Access and use of the website
You are solely responsible for the equipment used to access the website, as well as any telecommunication costs incurred by their use.
More generally, each time you use the Site, you undertake to behave in a normal and reasonable manner and not to hinder its proper operation in any way whatsoever.
Price list
The prices of our parts appear on the site and in the premises in euros.
Prices are shown inclusive of all taxes (VAT), the VAT applied being that of the day of booking.
We reserve the right to modify the price at any time.
However, the parties will be invoiced on the basis of the prices in force on the day of the customer's reservation.
We inform you that in the event of an erroneous price being displayed, which is clearly derisory in relation to the real value, for whatever reason (computer bug, manual error, technical error), the reservation - even if validated - will be cancelled.
We will inform you as soon as possible.
You will then be able, if you wish, to make a new booking at the correct price.
Terms of payment
Payment for products ordered on the site can be made :
- by credit card (Carte Bleue, Visa, Eurocard/Mastercard/American Express) directly on the Site. The card is debited as soon as the order is placed, except in the event of server unavailability. In this case, Ocean12 reserves the right to make a new request for debit authorization if the first request was unsuccessful due to server unavailability.
- or with your Paypal account. If you choose to pay via Paypal, you will automatically be directed to your Paypal account. Once the Paypal payment has been validated, you can complete your order on the Site.
Transactions carried out on the site are secured by the payment system of our partner, CIC. All information exchanged to process payment is encrypted using SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. At no time do your financial data pass through Ocean12's computer system.
In the event of fraudulent use of your means of payment, you are invited, as soon as you become aware of such use, to contact us via our e-mail address (contact@ocean12.paris).
An invoice is automatically sent to the customer by e-mail.
Finally, in the event of late or non-payment, Ocean12 may suspend all outstanding orders until the situation has been regularized, without prejudice to any other course of action.
Liability and Force Majeure
Ocean12 is responsible to the customer for the proper execution of reservations made on the site.
However, Ocean12 will not have failed in its contractual obligations insofar as their execution has been delayed, hindered or prevented by an event attributable to the Customer or resulting from the latter's fault, or by the unforeseeable and insurmountable act of a third party. The same shall apply in the event of any inconvenience or damage inherent in the use of the Internet network, or in the event of Force Majeure.
You declare that you accept the characteristics and limits of the Internet, and in particular its technical performance, response times for consulting, querying or transferring data and the risks associated with the security of communications.
In this regard, you acknowledge that :
- your use of the Site is at your own risk, the Site and its content being accessible to you "as is" and according to its availability;
- you are responsible for any damage to your equipment and/or loss of data resulting from downloading or consulting the Site;
- It is therefore your responsibility to take all appropriate measures to protect your own data and/or software from contamination by any viruses circulating on the Site;
- No advice or information, whether oral or written, obtained from Ocean12 or during the use of the Site is likely to create guarantees not expressly provided for in the General Conditions;
- you are solely responsible for your use of the Site;
- the communication of your access codes or in general of any information deemed confidential is made under your own responsibility;
- it is your responsibility to take all necessary measures to ensure that the technical characteristics of your equipment allow you to consult the Site.
Neither the customer nor OCean12 will have failed in its contractual obligations insofar as their execution will be delayed, hindered or prevented by a case of force majeure as defined by article 1218 of the French Civil Code.
In such a case, Ocean12 will inform the Customer of the occurrence of such an event within 3 working days of its occurrence, by e-mail.
After a period of 30 days and in the event that the event constituting force majeure persists, the order will be cancelled and reimbursed within a maximum period of 14 days.
